1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of The Context Graph newsletter, website, and related services (collectively, the “Service”) operated by The Context Graph (“we,” “us,” or “our”), located in San Francisco, California, United States.

By accessing or using the Service, you (“you” or “Subscriber”) agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service. If you are accepting these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18 (or the age of majority in your jurisdiction), you must have parental or guardian consent.

3. Description of the Service

The Context Graph provides a periodic email newsletter containing editorial content, analysis, commentary, and curated information relating to context graphs, artificial intelligence, enterprise technology, and related topics. The Service may also include a website with archived content and supplementary materials.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

4. Subscription and Registration

To receive the newsletter, you must provide a valid email address. By subscribing, you consent to receive periodic emails from us. You may unsubscribe at any time by clicking the “unsubscribe” link included in every email or by contacting us directly.

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of any account credentials associated with the Service.

5. Intellectual Property Rights

Our Content: All original content published through the Service — including but not limited to text, graphics, logos, design elements, compilation, and arrangement — is the property of The Context Graph and is protected by United States and international copyright, trademark, and other intellectual property laws. All rights are reserved.

Third-Party Content: The Service may include quotes, excerpts, data, and references from third-party sources. Such materials remain the intellectual property of their respective owners and are used for commentary, criticism, and educational purposes under the fair use doctrine (17 U.S.C. § 107) and equivalent provisions under applicable law. All third-party content is clearly attributed to its original source.

No Unauthorized Use: You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Service without our prior written consent, except as permitted by applicable law (e.g., brief quotations for review or commentary with proper attribution).

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation;
  • Reproduce, redistribute, or republish newsletter content without prior written authorization;
  • Use automated systems (bots, scrapers, or similar technology) to access, collect, or extract data from the Service;
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure;

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Not Professional Advice: Content provided through the Service is for informational and educational purposes only. It does not constitute investment, financial, legal, tax, or other professional advice. You should consult qualified professionals before making any decisions based on information obtained through the Service.

No Endorsement: Reference to any third-party products, services, companies, or organizations does not constitute or imply endorsement, recommendation, or sponsorship by The Context Graph.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE CONTEXT GRAPH, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your access to or use of (or inability to access or use) the Service;
  • Any content obtained from the Service;
  • Any conduct or content of any third party referenced in the Service;
  • Unauthorized access, use, or alteration of your transmissions or content.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed fifty United States dollars (US $50.00). This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless The Context Graph, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of the Service caused damage to a third party.

10. Third-Party Links and Content

The Service may contain links to third-party websites, resources, or content that are not owned or controlled by The Context Graph. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, limitations of liability, indemnification, and governing law.

12. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Jurisdiction: You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in San Francisco County, State of California, and you consent to the personal jurisdiction of such courts.

Informal Resolution: Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@thecontextgraph.co. We will attempt to resolve the dispute informally within sixty (60) days.

Class Action Waiver: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND THE CONTEXT GRAPH EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND.

13. International Users and EU/EEA Provisions

The Service is operated from the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

European Union / European Economic Area Users: If you are located in the EU/EEA, you have certain rights under the General Data Protection Regulation (GDPR) and applicable consumer protection laws. Nothing in these Terms shall limit or exclude any rights that cannot be limited or excluded under applicable EU/EEA law, including but not limited to:

  • Your statutory rights under the GDPR (see our Privacy Policy for details);
  • Your right to withdraw from distance contracts within 14 days (where applicable under the Consumer Rights Directive 2011/83/EU);
  • Protections against unfair contract terms under Directive 93/13/EEC;
  • Your right to bring proceedings in the courts of your member state of domicile.

For EU/EEA residents, where these Terms conflict with mandatory provisions of EU/EEA law, the mandatory provisions shall prevail.

UK Users: If you are located in the United Kingdom, you have rights under the UK GDPR and the Consumer Rights Act 2015. Nothing in these Terms limits those statutory rights.

14. California Residents

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). Please refer to our Privacy Policy for details on how we handle personal information of California residents.

Under California Civil Code Section 1789.3, California users are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by: (a) posting the updated Terms on our website with a revised “Last updated” date; and (b) sending a notice to your registered email address at least thirty (30) days before the changes take effect (or such longer period as required by applicable law).

Your continued use of the Service after the effective date of any changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and unsubscribe.

16. Severability and Entire Agreement

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and The Context Graph with respect to the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.
